Conditions of participation

Terms and conditions of the “Gift for your rating” special offer

I. Definitions

Terms used in the terms of the Special Offer mean:

a) Review – a review of the purchased product written in German, consisting of at least 100 characters without spatium, concerning the product and its features, containing no vulgarism, no offensive words and terms and violating neither morality nor law.
b) Gift – of one of the products mentioned in Annex No. 1 of the Terms and Conditions of the Special Offer, available free of charge exclusively for Special Offer Participants.
c) Online Shop – internet platform owned by the Organiser and operated under the address https://treetale.eu/, which enables retail on the internet.
d) Organiser – SelectWood sp. z o.o. with its registered office in Łódź, Poland. Address: Ludomira Rozyckiego 12/2, 93-586 Lodz, Poland. Telephone number: +48 422031590, E-mail: shop@treetale.eu.
e) Participant – an adult, natural person who has full legal capacity, a legal entity or an organisational unit without legal personality that uses the Online Shop and participates in the Special Offer.

II. General conditions

1. The terms and conditions of the special offer determine the principles of the offer “Gift for your rating”, hereinafter referred to as “Special Offer”: Special Offer.
2. Subject to the conditions set out below, the Special Offer consists of the granting of the Gift to those Participants of whom all the conditions mentioned in the terms and conditions of the Special Offer are cumulatively fulfilled.
3. The present terms and conditions of the special offer are available on the website https://treetale.eu/opinions/
4. The organiser of the special offer is SelectWood Sp. z o.o. with the seat in Łódź, Poland, Address: Ludomira Rozyckiego 12/2, 93-586 Lodz, Poland, hereinafter: SelectWood or Organiser.

6. The special offer will run in the online shop from 7:00am on 1 September 2021 until 11:59pm on 31 December 2025 or while stocks last.
7. The special offer “Gift for your rating” is targeted at customers of the Online Shop who cumulatively fulfil all the conditions mentioned in the terms and conditions of the special offer (hereinafter: Participants).
8. It is forbidden to prepare unlawful and immoral reviews.
9. Participation in the special offer is voluntary.

III. Conditions of participation

1. In order to participate in the special offer and receive the gift, the conditions listed below must be met cumulatively:
   a) The participant should buy at least one product in the online shop,
   b) The participant shall leave a review of the purchased product using the internet form received,
   c) The participant shall leave a review of the purchased product on the internet platform Google or Facebook.
2. After the participant buys the product, he/she will receive a one-time link to the rating form, with the help of which he/she should rate the purchased product. The participant should choose a score from 1 to 5. The participant should write his/her first name or nickname and the content of the rating and can optionally add a photo of the product. The rating on the internet platform Google or Facebook should be left by the participant himself/herself.
3. Both the fulfilment of the conditions of the special offer and the content of the evaluation will be verified by the organiser. The gift will not be granted to participants whose reviews contain false information or violate the terms and conditions of the promotion.
4. If a rating is positively verified, the participant will be informed about the granting of the gift by an e-mail. The email will be sent to the email address provided.
5. By participating in the special offer, the participant declares that he/she is the author of the rating and that the rating does not infringe any copyright of the third parties.

IV. Gift delivery

1. The gift will be sent within 10 working days from the date of positive verification of the rating.
2. Delivery is made only in the territory of the European Union.
3. The shipping methods indicated below are available:
   a) Courier delivery.
4. The costs of delivery shall be borne by the Organiser.

 

V. The copyrights

1. Leaving a rating is equal to a declaration by the participant that he/she is the author of the photos and that he/she owns copyright to the enclosed photos.
2. The participant declares that the enclosed photos do not infringe any copyright or personal property of the third parties.
3. When leaving a review and photos, the participant grants the organiser the non-exclusive copyright licence for these photos in exchange for the gift and without the right to additional compensation. The copyright licence includes the permission to use and dispose of the photos without time limits and territorial restrictions. By virtue of the copyright licence, the Organiser is specifically entitled to:
   a) to record and reproduce the work in whole or in part, in particular to share it on Facebook and Instagram, by any method, including printing, reprography, magnetic storage, digital technology, multimedia technology, regardless of the standard, system, format, on any medium, in any quantity and in any form;
   b) to place the original and all copies on the market, to lend, to rent and to lease;
   c) to distribute the Work in whole or in part, in particular to perform it publicly, to organise it, to broadcast it, to transmit it, to make it available to anyone, at any time, in any place, on the Internet;
   d) to place the Work on the computer network, including on the Internet, in whole or in part, without restriction.
4. The Organiser is entitled to use, add to, edit and archive in any form the photographs in the areas described in paragraph 3, in whole or in part, individually or as part of the anthology.
5. The organiser is entitled to edit the photos at his own discretion. The organiser may transfer the right to edit the photos to the third party.
6. If the photograph enclosed for judging contains a likeness, the entrant, by publishing the photograph without compensation, consents to the sharing of his/her image in the areas described in paragraph 3.

VI. The right of withdrawal

1. According to § 355, the participant has the right of withdrawal from the purchase contract remotely included.

VII. Complaints

1. The organiser is obliged to deliver the gifts without defects. If the gift has a defect, the organiser is liable for the defect under the conditions specified below and in accordance with valid law.
2. The customer has the right to make a complaint. The complaint shall be submitted by e-mail to the following address: shop@treetale.eu or in writing to the following address: Selectwood sp. z o.o., Ludomira Rozyckiego 12/2, 93-586 Lodz, Poland.
3. In order for the claim to be considered, the customer should send or hand over the gift. If possible, the proof of purchase should also be enclosed.
4. The complaint should particularly consist of the description of the problem, the identification of the order in question and the method of contact (e-mail address, telephone number and possibly address).
5. The complaint will be considered within 14 days from the date of collection.

VIII. Litigation

1. In the event of a dispute, the customer may use the European Online Dispute Resolution Platform at the internet address: http://ec.europa.eu/consumers/odr.

IX. Data protection

1. The personal data provided by the participants will be collected and processed by the organiser lawfully and in accordance with the data protection regulations.

X. Final provisions

1. The Participant accepts these terms and conditions of the Special Offer by participating in the Special Offer.
2. The Promoter reserves the right to vary these terms and conditions of the Special Offer for good cause.
3. Any amendments to the terms and conditions of the Special Offer shall be published on the website of the Online Shop in the form of a uniform text of the terms and conditions of the Special Offer. The amendments shall come into force 14 days after the date of publication.
4. The terms and conditions of the Special Offer shall enter into force on 1.09.2021
